Privacy Notice for Markem-Imaje Applicants | Updated October 2023

 

You (the “applicant”) have expressed an interest in employment opportunities with Markem-Imaje or one of its operating entities worldwide (the "Company", "we", "us", "our"). This Applicant Privacy Notice (“Notice”) describes our practices regarding the personal data that we will collect about you in connection with your application for such employment opportunities in our recruiting and onboarding system. Markem-Imaje is a company of Dover Corporation (parent company) which is based in the United States.

Markem-Imaje is committed to protecting personal data and intends to process personal data transparently and lawfully and to comply with applicable data protection laws, including the EU General Data Protection Regulation (" GDPR") and applicable local laws. 1. WHAT ARE PERSONAL DATA?

Personal data (also referred to as "data" or "your data") means any information relating to you in an identified or identifiable form. This Notice supplements other privacy notices you may receive in connection with your relationship with us, including, for example, the privacy notice you will receive if you accept a position with the Company regarding the use of your personal data within the HR Central system (our HR information system).

 

2. PERSONAL DATA WE COLLECT – SOURCES AND CATEGORIES

We will collect your personal data to process and consider your application for employment; to comply with legal obligations; to pursue legitimate interests of the Company, such as sharing your personal data with Dover Corporation for internal administrative purposes and use related to the employment opportunity; and when you otherwise voluntarily provide information to us. We will continue to collect personal data from the same sources.

The categories of personal data we may collect from these sources include the following:

  • Personal identifiers: Name, address, telephone number, e-mail address, postal address, an individually created/assigned username and password, country of residence, and other contact information;
  • Protected class information: You will be asked to voluntarily disclose your race, ethnicity and other diversity data, gender identity, and veteran status, but note that this information will not be used in any way during the consideration of your employment application, and will not be visible to anyone involved in the consideration of your potential candidacy for employment, and there will be no negative impact to your consideration if you choose not to disclose this information. This information will be used for internal analytics purposes, in an anonymized fashion, to assist the Company with initiatives around diverse talent attraction, and in the event that the Company is required to respond to inquiries, investigations, or proceedings, by governmental, administrative, judicial or regulatory authorities, including civil litigation.
    If you are applying for a position with a business unit or operating company in the United States that is subject to reporting requirements for US federal contractors, you will also be asked to voluntarily disclose your disability status (if applicable). Again, this information will not be used in any way during the consideration of your employment application, and there will be no negative impact on your consideration if you choose not to disclose this information; it will be used for internal analytics purposes, in an anonymized fashion, to assist the Company with initiatives around diverse talent attraction, to fulfill required reporting and regulatory requirements, and in the event that the Company is required to respond to inquiries, investigations or proceedings, by governmental, administrative, judicial or regulatory authorities, including civil litigation.
  • Professional/Employment information: CV, résumé, cover letter, descriptions of your skills and previous work experience (including internal and external work history), language skills, work authorization status, and whether you will need sponsorship for an employment visa. You may also be asked to voluntarily disclose your expected salary for your position, but there will be no negative impact to your consideration if you choose not to disclose this information.
  • Referral information: Whether or not you have prior or current experience working at Dover Corporation or any of its associated companies, have a family member or relative currently working at Dover or any of its associated companies, and information regarding how you learned about the opportunity.
  • Educational information: education information, professional and other work-related licenses, permits, and certifications held;

Your decision to apply for a position and to provide your personal data to us is voluntary. We indicate on our online form what types of personal data we need to receive from you in order to consider your application.

If you provide us with personal data of a reference or any other third party as part of your application, please make sure to obtain consent from that individual prior to providing the information to us.

Personal data from other sources

The Company may obtain personal data about you from your references in connection with your application, as permitted by applicable law. If we need to conduct pre-employment screening (such as a background check or drug screening) for you during the hiring process, we will ensure that you are provided with separate notice regarding the scope and the consequences of such screening.

We may also obtain certain information through automated means, such as cookies (including HTTP, HTML5, and Flash cookies), web beacons, web server logs, JavaScript, and similar technologies, including technologies designed to obtain information regarding your use of our Services (collectively, “cookies”). 3. PURPOSES FOR COLLECTION OF PERSONAL DATA: HOW WE USE YOUR PERSONAL DATA

Your personal data will be used for the Company’s personnel recruitment, management and planning purposes, as permitted by local law, including:

  • To process your application;
  • To assess your capabilities and qualifications for a job;
  • To conduct reference checks;
  • To respond to your inquiries and communicate with you about your application, and to send you information regarding employment opportunities and changes to our policies;
  • To complete the onboarding process if we offer you a position;
  • To investigate and resolve complaints, grievances, or misconduct;
  • Preparing for and acting in relation to inquiries, investigations, or proceedings, by governmental, administrative, judicial, or regulatory authorities, including civil litigation;
  • Where appropriate, and in an anonymized fashion, we may use demographic data (including protected class information) to assist us in efforts to evaluate and improve our outreach and talent attraction efforts among under-represented groups in specific geographic areas:
  • Network and system security and access-related issues, including protecting the company by monitoring internet access and use and emails transmitted;
  • Health and safety purposes;
  • Defending legal claims; and
  • Any other purposes relating to carrying out our business.

We do not use the personal data that you provide to make automated decisions with regard to your application. If we hire you, the personal data we collect in connection with your application may be incorporated into our centralized HR information system and may be used to manage the new-hire process; any such information may become part of your employee file and may be used for employment and management purposes.

The Company may transfer personal data to a third party in the event of any actual or potential reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).

The Company also may share personal data as we believe to be necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain.

No Sale of Personal Data: We do not sell the personal data of our applicants.

 

5. DATA TRANSFERS

We are a global organization and have operating companies in many countries. As part of your use of our site, you will have the ability to control whether your personal data can be viewed by recruiters from other operating companies outside of your country of residence, via your candidate profile visibility settings. If you indicate in those settings that you wish to make your profile visible to other company recruiters worldwide or to recruiters for other positions that you apply outside of your country of residence, your personal data may be transferred to, stored, or accessed by Dover Corporation and/or its operating companies of Dover Corporation worldwide, including their service providers, for recruitment purposes. This may include transferring personal data to countries other than the country where you are located. When your personal data is transferred to (or accessed from) a country outside the European Economic Area (“EEA”) for which the European Commission has not issued an adequacy decision, we will implement appropriate safeguards to ensure that your personal data remains protected. This may include entering into data transfer agreements, a copy of which you can obtain by contacting us as indicated in the “Contact Details” section below.

 

6. DATA RETENTION

We will retain your personal data for the period necessary to complete the application or hiring process. If you are not hired, after we respond to your application for the purpose of considering whether your skills are suitable for other opportunities within the Company and/or one or more of its affiliates, we will retain your personal data for the period set down in the Dover Data Retention Schedule applicable to such records, which will be provided to you upon request. 7. YOUR RIGHTS

The Company will process the personal data described above for the following purposes:

  • Online navigation:
    • to enable the proper and secure operation of our website/applications;
    • implementation statistics.
  • Review and evaluate your application for employment, including:
    • assess their skills and interest in career opportunities at Markem-Imaje;
    • process your application;
    • analyze their qualifications;
    • verify your identity and eligibility for employment.
  • Recruitment process:
    • organizing the recruitment process, assessments, and interviews;
    • reimburse potential expenses related to the recruitment process.
  • Incorporation process:
    • establish an employment contract;
    • organizing their integration.
  • Communicate with you about your application, respond to your queries, and schedule interviews.
  • To comply with our legal and regulatory obligations, and to manage our rights (for example, to enforce our claims in court).

We will not use your personal data for decisions based solely on automated processing if the decision produces legal effects concerning you or significantly affects you unless you have given your explicit consent to this processing.

 

8. CALIFORNIA APPLICANTS: YOUR RIGHT TO ACCESS INFORMATION WE COLLECT AND DISCLOSE ABOUT YOU

We are committed to ensuring that you know what personal data we collect. To that end, Californians have the right to ask us for the following information from us with respect to the personal data that we have collected about you the 12 months prior to our receipt of your request:

  • Specific pieces of personal data we have collected about you;
  • Categories of personal data we have collected about you;
  • Categories of sources from which such personal data was collected;
  • Categories of personal data that the business sold or disclosed for a business purpose about you;
  • Categories of third parties to whom your personal data was sold or disclosed for a business purpose; and
  • The business or commercial purpose for collecting or selling your personal data.

Your Right to Request Deletion of Personal Data

We Have Collected from You Upon your request, we will delete the personal data we have collected from you, except for situations where local law authorizes us to retain specific information, including when it is necessary for us to operate our business and support your functioning as our employee; perform a contract we entered into with you; for other internal uses; to maintain the functionality or security of our systems; or to comply with or exercise rights provided by the law.

Exercising Your Rights and How We Will Respond

To exercise your access or deletion rights, or to ask a question about your data subject rights, contact us by email at privacy@markem-imaje.com.

For requests for access or deletion, we will first acknowledge receipt of your request within 10 business days of receipt of your request. We will then provide a substantive response to your request as soon as we can, generally within 30 days from when we receive your request, although we may be allowed to take longer to process your request under certain circumstances. We usually act on requests and provide information free of charge, but we may charge a reasonable fee to cover our administrative costs of providing the information in certain situations.

In some cases, the law may allow us to refuse to act on certain requests. When this is the case, we will endeavour to provide you with an explanation as to why. If you are not satisfied with our responses, you have the right to lodge a complaint with a supervisory authority.

Verification of Identity – Access or Deletion Requests

We will ask you for two pieces of personal data and attempt to match those to information that we maintain about you.

If we are unable to verify your identity with the degree of certainty required, we will not be able to respond to the request. We will notify you to explain the basis of the denial.

Authorized Agents

You may designate an agent to submit requests on your behalf. If you are a California resident, the agent can be a natural person or a business entity that is registered with the California Secretary of State.

If you would like to designate an agent to act on your behalf, you and the agent will need to comply with our verification process. Specifically, if the agent submits requests to access, know or delete your personal data, the agent will need to provide us with your signed permission indicating the agent has been authorized to submit the request on your behalf. We will also require that you verify your identity directly with us or confirm with us that you provided the agent with permission to submit the request. Please note that this subsection does not apply when an agent is authorized to act on your behalf pursuant to a valid power of attorney. Any such requests will be processed in accordance with local law pertaining to powers of attorney.

 

9. DATA SECURITY

We have implemented technical and organizational measures to protect your personal data against accidental or unlawful destruction, loss, alteration, access, unauthorized disclosure or access. We make reasonable efforts to ensure a level of security appropriate to the risk of the processing, taking into account the costs of implementation and nature of the processing of personal data. However, data security incidents and breaches can occur due to a variety of factors that cannot reasonably be prevented; therefore, our safeguards may not always be adequate to prevent all breaches of security.

This Notice does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any website or service to which the site links. The inclusion of a link through your application process does not imply endorsement of the linked site or service by the Company. We encourage you to read the legal notices posted on those sites, including their privacy notices.

 

11. PERSONAL DATA OF MINORS

We do not employ or contract with minors under the age of 18 and do not knowingly collect or sell the personal data of such minors.

 

12. CHANGES TO THE NOTICE

We may in our sole discretion amend this Notice at any time in order to address future developments of the Company, or changes in industry or legal trends. We will post the revised Notice on the site or announce the change on the home page of the site. You can determine when the Notice was revised by referring to the “Last Updated” legend at the top of this Notice.

Any changes will become effective upon the “Last Updated” date.
